Nuisance Cold Calls - What you need to know

Nuisance Cold Calls are an unlawful activity in the UK and if you are receiving calls of this nature then you must take the following action.

If you do not know the company or the person who is calling you, you must not engage in a telephone conversation with the person calling you. If you do not who is calling you, or how they got hold of your personal information, then there is nothing we or the UK authorities can do for you.

If know who it is who has contacted you, and you can provide the following information:

  • The name of the company or person calling you
  • The contact telephone number of the company or person calling you
  • The address details of the company or person calling you
  • The website address of the company or person calling you
  • Explain that you did not authorise them to contact you, or you do not why they are contacting you.  

If you have this information, you must report this unlawful activity to the Information Commissioner’s Office immediately.

The Timeshare industry is plagued with nuisance telephone cold callers who obtain timeshare owner’s personal data unlawfully to create fear and concern to take money from owners, often over the telephone or via a prearranged video call. 

Regardless of what you have been told by an unlawful nuisance cold caller, Praetorian Legal (or its associate companies) cannot assist you, and it is your responsibility to report this unlawful activity. Please note that Praetorian Legal will not engage with clients complaining to them about cold callers, unless you can provide full written details of who the cold callers are. There is nothing more we can do to assist you if you do not know the identity of the person you have spoken with.

If you are a client of Praetorian Legal, Mercantile Claims, or Missold Claims Assist, and you have signed an agreement with us, then you are under a legal obligation not to contract or discuss your timeshare matter with any other company or person regardless of what you have been told by them.

If you contract with any other company or person this may affect any ongoing claim you have with us and you will be responsible for our fees in full.

If your claim is with the Financial Ombudsman Service and you enter into an agreement with an unregulated company this will invalidate the agreement between yourself and Praetorian Legal. You will jeopardise your claim going forwards, and our fees will be payable immediately.
